Smoke Free Legislation

This page tells you about the new smoke free legislation that came into force on 1 July 2007, including contact details if you have any concerns about a premises in Derby.

From 1 July 2007 it will be against the law to smoke or allow people to smoke in workplaces and enclosed public places.

Under the Smoke Free (Premises and Enforcement) Regulations 2006 (Made under the Health Act 2006), proprietors and managers must therefore ensure that all workplaces, work environments and enclosed public places are smoke free.

In order for businesses to comply they will need to:

• Ensure the business becomes no smoking by the 1 July 2007;
• Display signs in prominent positions throughout the business, (normally at the entrances) to inform employees, visitors and members of the public that smoking is not allowed;
• Develop policies and procedures for preventing or attending to breaches in the legislation.
• Train employees on how to manage and prevent incidence of smoking within the premises.
• Company vehicles are included as places of work, therefore smoking in shared company vehicles must stop.

If customers and employees are allowed to smoke outside, the business must manage where they do so. You will need to ensure
• Smoke doesn’t enter the premises.
• Any external shelter walls are less than 50% enclosed.
• Planning permission and/ or building regulation approval
The shelter may also need either building control or planning permission.

Other areas to consider are the management of smoking related litter (cigarette waste/ food/ beverage packaging), noise, antisocial behaviour, and blocking highways when people congregate outside premises to smoke.
