Consumer Advice
Consumer Advisors give civil law advice to anyone who lives within the City of Derby or has made a purchase within the city. The same legal advice is available to traders within the city. Requests for advice are received in person and by letter. Consumer Advice for telephone callers is provided by the Consumer Direct call centre.
Unbiased advice must be given with minimum delay, as many transactions have legal 'cooling off' periods allowing consumers to opt out of commitments if they react quickly. Consumer Advisors have a working knowledge of Trading Standards legislation and are able to identify potential breaches of this legislation when dealing with a complaint. Increasingly advisors are being required to investigate civil breaches of legislation for enforcement action in the County Courts. Our main duties are:
- Work with the Consumer Direct call Centre
- Receipt of consumer complaints and provision of timely self-help advice relating to transactions which affect city residents or have taken place within the City of Derby
- Receipt of enquiries and provision of timely self help advice to traders based within the city.
- Identification of potential breaches across the whole range of criminally based Trading Standards legislation
- Identification of problem traders for referral to the Office of Fair Trading.
- Identification of civil breaches of the Unfair Terms in Consumer Contracts Regulations 1999, the Distance Selling Regulations 2000 and the Enterprise Act 2002.

Enquiries Section
The aim of the Trading Standards enquiry team is to investigate criminal breaches of Trading Standards legislation that occur within the City of Derby. These mostly arise via complaints handled by the Consumer Advice officers or referrals by other enforcement authorities or Consumer Direct.
The team undertakes projects to monitor trading practices giving rise for concern. Participation in major national investigations requiring input from Derby City Trading Standards is another responsibility. A detailed investigation is not always appropriate; advice, warning or referral to the appropriate “home authorities” are frequently used alternatives. Our main duties are:
- Investigation of potential breaches of Trading Standards legislation
- Liaison with other enforcement bodies and external statutory and advisory bodies.
- Test purchase exercises for under-age sales
- Enforcement projects
- Enforcement of the Enterprise Act 2002.
Calibration Services
The council runs a calibration service maintained through a quality system, with designated officers responsible for the delivery of the calibration service provided by the Trading Standards Laboratory.
