Domestic properties
Development at domestic properties does not always need planning permission, some development can be carried out under the permitted development rights.
On 1st October 2008 new legislation came into force that affects the permitted development rights of domestic properties, we advise that you read through the our set of guidance notes on Permitted Development Rights
or for further guidance please visit Planning Portal - further guidance
We also advise you to check with us first before you start any work. General advice can be given over the telephone or by prior appointment at Roman House by a member of the Development Control Team, who are available between 10.00am and 4.00pm Monday to Friday. If you would like written confirmation that your proposed development will not require planning permission please complete the Lawful Development for Proposed Use / Development Application Form
and send it with all the required information, together with the relevant fee, which is currently half the fee for a planning application, to:
Development Control
Regeneration and Community
Roman House
Friar Gate
DERBY, DE1 1XB
Once we have received the forms and plans they will be assessed by a planning officer and based on the information you have provided we will either issue a Certificate of Lawful Development or advise that you will need to submit a planning application. If you do need planning permission, we will not be able to confirm whether the Authority will grant permission at this stage.
Commercial Properties
If you are a developer or a professional adviser, you should make an appointment to see someone familiar with the area concerned to make sure that the discussion is of most use. We can, however, answer simple enquiries over the phone: Development Control contacts.
The links below will take you to online versions of free booklets published by the Government, these only give basic information and we recommend you contact us to be sure of the most up-to-date advice:
Alternative paper copies of all the above booklets can be obtained from our Co-ordination Services.
If you need planning permission
If you do need planning permission for your development, we can provide you with advice. We can explain how to apply and what the process involves, you may like help with the forms, or with putting your proposal into a format that we will be more likely to approve. We can go through your proposals and any drawings you might want to show us before you make a formal planning application. Please make an appointment to see an officer at the Roman House reception by telephoning 01332 255950.
The advice we give will be objective, on the basis of the information available at the time. We will give you information about relevant planning policies and previous decisions where appropriate, and about our standards for things such as parking provision. We would hope to be able to give you the likely time scale for dealing with your planning application.
Charging for Pre-Application Advice
Alternatively you can find further advice and submit your application including plans and supporting documents online at the Planning Portal
